Below are our standard terms and conditions which accompany all our bookings and that we must have in place to satisfy the requirements of our insurance policy, and to make everything clear and fair. It is our intention that they are reasonable and we will always aim to be fair and prompt in our dealings with our guests. If you have any questions, please feel free to ask us.
General
Once a Booking is made, these Terms and Conditions form a legally binding contract between Steven and Louise Robinson (the “Property Owners”) and the Holidaymaker. The Property Owners are also referred to as "we" and "us". The Holidaymaker is the person who signs the booking form or, in the case of online booking, the person who makes the online payment. This person is responsible for ensuring all members of the holiday party accept and adhere to these Terms and Conditions. The Holidaymaker is also referred to as "you". The property referred to being Gull Cottage, 4 Penally Terrace, Boscastle PL35 0HA (“the Property”).
Bookings
The booking is taken on a provisional basis until a deposit has been paid in full and funds cleared through the banking system (where appropriate). The booking then becomes confirmed. Until the booking is confirmed, it can be cancelled at any time without prior notice.
The balance of the rental charge, along with any breakage deposit, is payable not less than seven weeks prior to the start of the holiday. Failure to pay the deposit or balance in full by the due dates will constitute a cancellation of the holiday by the Holidaymaker. Please be sure to note the due dates of these payments as reminders are not routinely issued.
Bookings made less than seven weeks prior to the arrival date must be paid in full at the time of booking.
Cancellation by the Holidaymaker
Cancellation of the booking by the Holidaymaker should be made in writing to the Property Owners. In the event of a cancellation, we will attempt to re-let the Property and if successful, a discretionary payment up to a maximum of the re-let booking value may be made. However, we strongly recommend you take out holiday cancellation insurance.
Cancellation or Amendment by the Property Owners
The Property Owners will endeavour to make sure the Property is available for the dates contracted and would not expect to have to make any changes to the Booking once it is agreed between you and us. In the unlikely event the Property becomes not available, and the Property Owners have to cancel the booking, the Property Owners will endeavour to find the Holidaymaker suitable alternative accommodation. If suitable alternative accommodation cannot be found, the Holidaymaker shall be entitled to a full refund. The Property Owners shall only be liable to return the monies received. No compensation or consequential losses shall be paid.
Number of Guests
The maximum number of people entitled to stay at this Property is eight and furthermore, only those people named on the booking, or subsequently agreed by the Property Owners in writing or by email, are entitled to stay. If it is found that more people than agreed are using the Property, this will be considered a breach of contract and the Holidaymaker and his/her party will be asked to leave immediately without any refund.
Sub-letting or reassigning the booking to someone else is prohibited.
Arrival and Departure Time
Every effort will be made to have the Property available from 4.00 PM on the day of arrival. The Property must be vacated by 10.00 AM on the day of departure. Late departure will result in an additional charge being made. Information about keys and how to collect them will be provided after full payment has been received and typically two weeks before arrival.
During any period of heightened infection risk, such as during the Covid-19 pandemic, we may adopt additional cleaning procedures which may affect check-in and check-out times. We would aim to give the Holidaymaker as much notice as possible of any changes.
General Provisions
Whilst every care is taken to provide a true and accurate description of the Property, over time, alterations are made and some things do change. The Holidaymaker accepts that no refunds are available for such discrepancies.
The Property Owners reserve the right to enter the Property, at a reasonable time, in the event of an emergency or remedial repair work being required.
You agree not to do anything that may be reasonably considered to cause a nuisance or annoyance to us or to any other occupier of adjoining or neighbouring properties. The Property Owners are entitled to ask the Holidaymaker to leave the Property without any refund if, in the Property Owners’ opinion, the behaviour of the Holidaymaker or anyone in his/her party is unacceptable.
The Property Owners reserve the right to refuse entry to anyone, who in the Property Owners’ opinion is not suitable to or capable of taking charge of the Property.
You agree to comply with the regulations set out in any property manual at the Property and any other regulations reasonably specified by us, and ensure that they are observed by all members of your party.
Pets
Pets are not allowed in the Property without the Property Owners’ prior agreement in writing or by email. This is normally reserved for regular guests only. If it is agreed pets can stay, they must be house trained and the number, type and breed of pets must be what was agreed at the time of booking, otherwise a breach of contract will be deemed to have taken place.
Pets must not be left unaccompanied in the Property at any time and must not be allowed on the furniture nor anywhere upstairs. The Holidaymaker shall be liable for all damage caused by his/her pet or any pet belonging to the Holidaymaker's party. A charge will be made for any additional cleaning required. The Property Owners cannot be held responsible for any accident or injury to a pet during their stay.
Smoking
Smoking is strictly forbidden inside the Property. Holidaymakers are asked to be considerate towards neighbours when smoking outside.
Limited Liability
The Property Owners take no responsibility for the personal possessions of the Holidaymaker or the Holidaymaker's party. Vehicles and possessions are left entirely at the risk of the Holidaymaker.
Children must be supervised at all times, particularly on the terrace and in front of the Property.
Our maximum liability for any losses you suffer as a result of us acting in breach of these Terms and Conditions is strictly limited to the amounts received by us in relation to your Booking.
Breakages
The Holidaymaker should make every effort to keep the Property, fixtures and fittings and all contents in the same state of repair and condition as at the start of the holiday. Any accidental damage or breakages should be reported to the Property Owners (or their housekeeper) prior to departure. The Property Owners retain the right to make an additional charge for damage and breakages although it should be noted that minor breakages and reasonable wear and tear (in the opinion of the Property Owner) will not be charged for.
Return of Breakage Deposit
If you pay a breakage deposit it will be returned to you, minus any deductions, within two weeks of your departure.
Other Provisions
If at any time any part of these Terms and Conditions is held to be unenforceable for any reason under any applicable law, that part shall be deemed omitted and the enforceability of the remaining parts shall not in any way be affected by that omission.
these Terms and Conditions and our confirmation email contain the entire agreement between us and you relating to the Booking.
Complaints
Every endeavour is made to ensure your stay with us is memorable for all the right reasons. However, we do recognise that from time-to-time things do go wrong. In these circumstances, it is the responsibility of the Holidaymaker to make any such problem known to the Property Owners (or their housekeeper) immediately it becomes apparent, thereby giving the Property Owners the opportunity to correct the situation. Unless this procedure is followed, no subsequent claim will be entertained.
The Property Owners will make every endeavour to rectify any identified problems as soon as is reasonably possible.
Law and Jurisdiction
These Terms and Conditions (including any non-contractual obligations arising in relation to these Terms and Conditions) is governed by the law of England and Wales and we both agree that any dispute, matter or other issue which arises between us will be exclusively dealt with by the Courts of England and Wales.
